Terms of Service

1. Agreement to Terms

By accessing or using PassCare (“the Service”), operated by PassCare Ltd (“we”, “us”, “our”), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation.

2. The Service

PassCare provides online mandatory training, compliance tracking, and certificate generation for healthcare organisations in the United Kingdom. The Service includes eLearning modules, quizzes, compliance dashboards, and certificate verification.

3. Accounts & Registration

You must provide accurate, complete information when registering. Organisation administrators are responsible for managing access for their staff members. You are responsible for maintaining the confidentiality of your account credentials.

4. Subscriptions & Billing

PassCare offers a 14-day free trial with 5 seats. After the trial, a paid subscription is required. Billing is per-seat, per-month (or annually). Prices are in GBP and exclusive of VAT where applicable. Payments are processed by Stripe. You authorise us to charge your payment method for recurring fees.

5. Training Content

All training content is created by qualified healthcare professionals and is for educational purposes. PassCare training does not replace hands-on practical training where required (e.g., BLS skills stations, Moving & Handling practical assessment). Certificates indicate successful completion of the eLearning component only, unless a practical sign-off is recorded by an authorised training provider.

6. Certificates

Certificates are generated upon successful completion of training modules (minimum 80% quiz pass mark). Each certificate has a unique verification code and QR code. Certificates are valid for the period specified by the relevant training framework (e.g., 12 months for CSTF). Expired certificates remain verifiable but display expired status.

7. Data Protection

We process personal data in accordance with UK GDPR and the Data Protection Act 2018. See our Privacy Policy for full details. Training records are retained for 6 years by default (aligned with NHS Records Management Code), configurable per organisation.

8. Acceptable Use

See our Acceptable Use Policy. You must not misuse the Service, share login credentials, fabricate training records, or attempt to circumvent security measures.

9. Intellectual Property

All training content, platform design, and branding are owned by PassCare Ltd. Organisations may download certificates and compliance reports for their own operational use. Content may not be redistributed, resold, or used to create competing products.

10. Limitation of Liability

PassCare provides training for educational and compliance purposes. We do not guarantee that use of the Service will result in passing CQC inspections or meeting all regulatory requirements. Our liability is limited to the fees paid in the 12 months preceding any claim.

11. Termination

Either party may terminate at any time. Upon cancellation, access continues until the end of the billing period. Data export is available for 30 days after termination. After 30 days, data is deleted except where retention is required by law.

12. Governing Law

These Terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the English courts.
